LIABILITY WAIVER & ASSUMPTION OF RISK

In consideration of participation in the Blue Lightning Track Club Time Trial on October 25, 2026, including warmups, running events, athletic evaluations, and related activities (collectively referred to as the "Event"), I, on behalf of myself and/or the minor participant(s) identified in this Agreement, acknowledge and agree to the following:

1. Acknowledgment of Inherent Risks

I understand that participation in track and field activities involves inherent risks, including but not limited to running-related injuries, falls and collisions, muscle strains and sprains, heat exhaustion and dehydration, equipment-related injuries, and the possibility of serious bodily injury, permanent disability, paralysis, or death.

I voluntarily assume all risks associated with participation in the Event, whether known or unknown, including risks associated with athletic exertion, facility conditions, weather, and the actions of other participants.

2. Physical Condition & Medical Eligibility

I certify that each participant covered by this Agreement is physically fit, properly conditioned, and medically able to participate safely in track and field activities.

I understand that participation may involve strenuous physical exertion, including sprinting, running, warmups, and other athletic evaluations.

I acknowledge that it is my responsibility to consult with a licensed physician regarding participation in strenuous athletic activities when appropriate.

I further affirm that any medical conditions, allergies, medications, or existing injuries that may affect safe participation have been disclosed to Blue Lightning Track Club, LLC.

I agree not to permit participation when a participant is ill, injured, or otherwise medically unable to participate safely.

3. Medical Treatment Authorization

In the event of illness, injury, or medical emergency, I authorize Blue Lightning Track Club, LLC staff, coaches, volunteers, officials, athletic trainers, and emergency medical personnel to obtain or arrange medical treatment deemed necessary for the participant.

I understand that reasonable efforts may be made to contact the parent, legal guardian, or emergency contact when circumstances permit.

I understand and agree that I am responsible for medical expenses incurred as a result of such treatment, to the extent permitted by law.

4. Release of Liability

To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and hold harmless Blue Lightning Track Club, LLC, its owners, directors, officers, employees, coaches, volunteers, officials, sponsors, venue operators, agents, contractors, and affiliated organizations (collectively referred to as the "Released Parties") from any and all claims, liabilities, demands, damages, costs, expenses, or causes of action arising out of or related to participation in the Event, including claims arising from the ordinary negligence of the Released Parties.

This release includes, but is not limited to, claims involving personal injury, illness, property damage, economic loss, and wrongful death, to the extent such claims may lawfully be released.

Nothing in this Agreement is intended to release liability that cannot legally be waived under Georgia law.

5. Compliance With Rules & Conduct

I agree that each participant will follow all Event rules, facility policies, safety instructions, and directions provided by coaches, staff, and designated Event personnel.

I understand that failure to comply with safety instructions or engaging in unsafe, disruptive, abusive, or unsportsmanlike conduct may result in removal from the Event.

Blue Lightning Track Club, LLC reserves the right to restrict or discontinue participation when necessary to protect the safety of participants and others.

6. Weather, Event Changes & Refund Policy

I understand that outdoor athletic activities may be affected by weather, facility conditions, scheduling adjustments, or unforeseen circumstances.

Blue Lightning Track Club, LLC reserves the right to modify, delay, reschedule, or cancel any portion of the Event for safety or operational reasons.

I understand that any applicable participation or registration fees are subject to Blue Lightning Track Club, LLC's established refund policies.

7. Communicable Disease Acknowledgment

I understand that participation in athletic activities may involve exposure to communicable illnesses, including viruses, bacteria, and other infectious diseases.

I voluntarily assume the inherent risks of such exposure associated with participation and release the Released Parties from related claims to the fullest extent permitted by law.

8. Indemnification

To the extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties from claims, damages, losses, liabilities, or reasonable expenses arising from my own actions or omissions, the participant's intentional or reckless misconduct, or violations of Event rules.

This provision applies only to the extent legally enforceable and does not require indemnification for liability that cannot lawfully be shifted to the signing party.

9. Venue & Property Damage Responsibility

I understand that participants and spectators are expected to respect McDonough High School facilities, athletic equipment, and venue property.

I accept financial responsibility, to the extent permitted by law, for property damage caused by the participant through intentional misconduct or reckless behavior.

10. Electronic Signature Consent

I consent to the use of electronic records and signatures for this Agreement.

I agree that my electronic signature reflects my intent to sign and accept this Agreement and shall have the same legal effect as my handwritten signature to the extent permitted by applicable law.

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia.

MEDIA, PHOTO & VIDEO RELEASE

I hereby grant Blue Lightning Track Club, LLC permission to photograph, record, livestream, and use the participant's name, image, likeness, voice, athletic performance, and appearance in photographs, videos, digital recordings, and promotional materials created during the Blue Lightning Track Club Time Trial.

I understand and agree that such materials may be used for:

Blue Lightning Track Club websites and digital platforms

Social media posts and promotional campaigns

Team marketing and recruitment materials

Athletic highlights and performance videos

Livestream broadcasts and recorded Event coverage

Printed publications, advertisements, and media coverage

I acknowledge that:

No compensation will be provided for the authorized use of these materials.

Blue Lightning Track Club, LLC retains ownership of media content it produces, subject to applicable law and third-party rights.

I waive the right to inspect or approve final media materials before publication.

I release Blue Lightning Track Club, LLC from claims arising from the authorized use of such materials, to the extent permitted by law.

This authorization includes the use of images and recordings for legitimate promotional, educational, informational, and historical purposes related to Blue Lightning Track Club.

ACKNOWLEDGMENT & SIGNATURE

I HAVE READ THIS AGREEMENT CAREFULLY AND UNDERSTAND ITS TERMS, INCLUDING THE ASSUMPTION OF RISK, RELEASE OF LIABILITY, MEDICAL AUTHORIZATION, AND MEDIA RELEASE PROVISIONS.

I acknowledge that participation in the Blue Lightning Track Club Time Trial is voluntary.

By electronically signing below, I certify that:

I am at least 18 years of age.

I am the participant or the parent or legal guardian of the minor participant(s) identified in this Agreement.

I have legal authority to execute this Agreement in the capacity indicated.

All participant information provided is accurate to the best of my knowledge.

I understand the potential risks associated with participating in the Event.

I voluntarily accept the terms of this Agreement on my own behalf and, where legally permitted, on behalf of the minor participant(s) identified below.
